TERMS AND CONDITIONS
General
"We" means Acton Gate Audio LTD, 4 Ruabon Road, Wrexham, North Wales,
LL13 7PB.
"You" means the customer named on the order form provided on the Acton
Gate Audio website.
These Terms and Conditions, together with the information contained in our Shopping Basket Help govern your use of and purchase of products from this site. Our acceptance of your order constitutes a legally binding contract between us. In the event of any dispute, the applicable law is UK law.
We shall not be liable to you where performance of any of our obligations to
you is prevented, frustrated or impeded by reason of acts of God, war and other
hostilities, civil commotion, accident, strikes, lock outs, trade disputes,
acts or restraints of Government, imposition or restrictions of imports or exports
or any other cause not within the reasonable control Of Acton Gate Audio LTD.
We may at any time make changes to this site and the details displayed on it
(including prices).
Price & Payment
The prices for goods displayed for sale on this site are inclusive of VAT as
set out on the site, plus any additional charges for delivery as set out in
Shopping Basket Help. Prices and delivery
charges displayed are valid and effective only in the United Kingdom.
We must receive payment for the full price of the goods you order, and any applicable
charges for delivery, before your order can be accepted. Upon payment, we will
confirm acceptance by e-mail. We reserve the right not to accept your order,
and therefore not to supply you, at our discretion.
Availability
While we endeavour to hold sufficient stock to meet all orders, if we have insufficient stock to supply or deliver the goods ordered and paid for by you, we will refund you the price paid for such goods as soon as possible and in any case within 30 days.
Cancellation
You may cancel your order by giving us written notice of cancellation within 14 days of the date of delivery. Written notice of cancellation can be posted, emailed or faxed to us at the address set out at the end of this section. If you are canceling because of any problem with the goods, please notify us of the problem at the time of cancellation.
We aim to process your order for dispatch to you within two working days of receiving it. Therefore, even if you do cancel your order shortly after placing it, it is possible that we will be unable to prevent any goods you have ordered being dispatched to you and you may then need to return them to us at your cost.
Refunds will be made within 30 days of receipt of your notice of cancellation, or, where goods are to be returned to us, within 30 days of the receipt of such goods by ourselves.
We will meet the cost of return, if the goods are being returned because they are faulty, incorrect goods or because of unsuitable substitution by us. Please see our Returns policy.
Returns Policy
On cancellation for whatever reason you must return to us the goods we have
delivered to you. If the goods are faulty, incorrect or damaged on delivery
we will meet the cost of return (but we ask that you allow us to nominate the
carrier). Depending on the weight and value of the goods we may ask you to return
the goods via Royal Mail in which case we will reimburse your costs upon receipt
of the goods. Please ensure that the goods are suitably packaged to prevent
damage in transit.
We will also (at your option) replace or exchange any such goods; or refund
you for the price paid including delivery charges. In all other circumstances
we will (at your option) exchange the goods or refund you the amount paid (excluding
delivery charges) only.
You may return items to any of our stores, if more convenient, however we do
ask that you provide proof of purchase and advise the store that you purchased
the goods via acton-gate-audio.co.uk.
We will not be liable to you for any loss of profits, administrative inconvenience,
disappointment, indirect or consequential loss or damage arising out of any
problem in relation to the goods and we shall have no liability to pay any money
to you by way of compensation other than any refund we make under these conditions.
This policy is in addition to any statutory rights you may have as a consumer,
which remain unaffected.
Complaints Procedure
We undertake to handle all complaints fairly and competently. We will keep you informed either by telephone or email at each stage and will endeavour to fully resolve your complaint as soon as possible.
Privacy
We will not collect any information about individuals, except where it is specifically and knowingly provided, for example, at the time of ordering. When you order, we collect personal information such as your name, e-mail address, delivery address, telephone number, and credit or debit card details. This allows us to process and fulfil your order(s) and to notify you about the status of your order(s).
We will also collect non-transactional data should you enter a competition, request a brochure, or contact Acton Gate Audio via one of the electronic forms provided.
We may also use the information we collect to occasionally notify you about news and information about goods and services we think you may find valuable. If at any stage you decide you would rather not receive such information please contact us online by completing the form in Contact Us and checking the box so that you are not placed or retained on our mailing list.
We employ contractors to perform functions on our behalf. Examples include delivering packages and processing credit card payments. Our contractors have access to personal information needed to perform their functions, but may not use it for other purposes.
